RE: City of San Bernardino Annexation No. 361 / LAFCO No. 3067A-F
Dear Property Owner/Resident:
As you are probably aware, sometime ago the City of San Bernardino submitted an application to the Local Agency Formation Commission (LAFCO) for the annexation of portions of six unincorporated islands. The application was a condition of approval by LAFCO for the City's annexation of the Arrowhead Springs area. At their November 18, 2009 hearing, LAFCO approved the annexation of these islands. The final processing of the annexation was completed by LAFCO's issuance of a "Certificate Completion", with an effective date of February 22, 2010.
On February 25, 2009, the City was served with a lawsuit filed by Susan Hulse against LAFCO and the City to invalidate the annexation of the six county islands pursuant to the California Environment Quality Act (CEQA) and other State laws.
We had previously notified you that the City and County entered into an Agreement to transfer the delivery of all public services back to the County, pending the final outcome and judgment of the lawsuit. The effective date of the transfer of public services back to the County of San Bernardino was May 21, 2010.
We also indicated in that letter, that you would be notified of any change of status regarding these annexations. On August 13, 2010, a Stipulated Judgment, agreed to by all parties involved in the lawsuit, was approved by the Court. As set forth in the stipulation, the annexation of the six islands to the City of San Bernardino are rescinded and jurisdiction for various public services and tax revenues are transferred back to their respective agencies and/or districts as they existed prior to the approval of the annexation by LAFCO. You will be receiving mailed notice from LAFCO at a future date, regarding the reversal of the annexation.
